With more and more Britons venturing abroad on holiday, the numbers of people being injured or falling ill whilst outside the country is inevitably growing. If you have been injured or fallen ill whilst on holiday, it is possible for you to claim compensation. Of course it goes beyond saying that you should always have proper travel insurance when you go abroad.
Whether you were traveling by train, plane, coach or boat, the company with whom you travelled must comply with international standards with regard to safety and service – if these standards have not been met then you can claim compensation.
If you were on a package holiday and fell ill or were injured as a result of somebody else’s failing, you may able to claim compensation. The tour operator from whom you purchased the package holiday has a duty of care for you, and a responsibility to provide you with what they promised, any failing in this duty entitles you to compensation. As a result of the 1992 Package Travel Regulations, you can now pursue a course of action against a travel company through the British courts rather than abroad.
When pursuing a claim for compensation as a result of illness or injury whilst on holiday, you can claim for:
- Loss of income as a result of negligence
- Travel costs as a result of medical malpractice
- Cost of any further treatment necessary to correct the negligent work
- Physical pain and suffering
- Emotional pain and suffering, including psychological therapy
